Life-Altering Workplace Injury
Our client faced a life-changing ordeal when a large oak tree fell on the truck he was driving, causing severe injuries while on the job. He sustained a traumatic brain injury, broken ribs, required a tracheostomy, and continues to struggle with walking. His recovery included treatment at the renowned Shepherd Center in Atlanta.
At Powers Law Group, we were with him every step of the way. We successfully secured a significant settlement and established a Medicare Set-Aside account to cover future medical care.
What is a Medicare Set-Aside account?
A workers’ compensation Medicare Set-Aside (MSA) reserves settlement funds for future treatment related to the work injury that Medicare would otherwise cover. This helps protect Medicare’s interests when settling a claim.
Managing future medical care
The injured person or a professional administrator can manage the account. Funds must be used appropriately for covered injury-related care, with records maintained. Medicare’s payment responsibility depends on proper use of the funds and applicable Medicare rules.
When will CMS review a proposal?
Submission for CMS review is voluntary. CMS generally reviews proposals when the claimant is a Medicare beneficiary and the settlement exceeds $25,000, or when Medicare enrollment is reasonably expected within 30 months and the anticipated settlement exceeds $250,000. These are review thresholds, not a rule that every settlement above them requires an MSA or that lower settlements can ignore Medicare’s interests.

Medicare resources for Georgia residents
Georgia residents can also seek Medicare counseling through Georgia SHIP. Programs such as Medicare Savings Programs and Extra Help may assist eligible beneficiaries with Medicare costs. These services are separate from the administration of an MSA.
